Victims' Stories: Aryan (Not his real name)

  • Married Hetalben in December 2004 (Gujarat, India), and submitted his Family Class sponsorship application in March 2005
  • Application was processed in 3 months, and his wife came to Canada in early July 2005
  • Hetalben left Aryan and his family members (mother, brother, brother's wife, 2 nephews) within 3 days, then to live with a friend (Neha) in North York
  • In those 3 days, she made very disturbing remarks to him, saying that she did not love him, she only came to Canada because of her parents, she is going to leave him in 2 months; she had a boyfriend in India whom she thinks of every minute, every second, etc. Aryan was confused by all of this, and thought she was saying those things because his wife may have been upset with something he may have said or done
  • After being dropped off by Aryan's family members voluntarily, she filed a case of domestic violence against him (15+ hours later); Aryan was charged, even without any police investigation or questioning; police report showed no evidence of any form of abuse; he was cleared in February 2006 after a court appearance
  • Her family, friends, and relatives have never contacted him or his family even once afterwards
  • Aryan has clear evidence and a very strong case, but CIC has not investigated the matter
  • Filed for annulment (declaration by court that the marriage is invalid) in January 2006 and courts agreed to grant the annulment in July 2006
  • He has suffered emotionally, financially, mentally, socially
  • He cannot continue with his normal life
  • Called Immigration Canada (1-888-242-2100) on the day that she left (even before domestic violence complaint), wrote a letter to CIC in Mississauga few days later, also wrote to ex-honourable minister, Joe Volpe; went to ex-MPs office of Tony Valeri and was told that CIC will call him for an interview (never happened); Nov'05 - received a letter from Elaine Cooke (Director of Ministerial Enquiries Division) indicating that the information was forwarded to Waterloo for further review; January 2006 - contacted MP, David Christopherson's office and CIC informed his office that they hope to begin investigating the case in 2-3 months (nothing happened); In June 2006, he went to MPs office of Wayne Marston, and they notified him that CIC will get back to him in January 2007 (another lie??); wrote to Monte Solberg in June 2006, but no response; also wrote to the Minister of Public Health & Safety for marriage fraud awareness, but no response; e-mailed Canadian Border Services Agency in August 06 for the first time, they kept informing him to write to Monte Solberg, which he has already done
